Term Of Service

1. Eligibility

You must be at least 13 years old or the minimum legal age in your jurisdiction to use this App. By using the App, you represent and warrant that you meet the age requirements and have the legal capacity to enter into this Agreement.

2. Account Registration and Security

To access certain features of the App, you may be required to create an account. You agree to provide accurate, complete, and updated information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. User Conduct

You agree not to use the App to:

• Violate any applicable law or regulation;
• Infringe the rights of any third party;
• Transmit any harmful, offensive, or fraudulent content;
• Attempt to gain unauthorized access to our systems;
• Engage in any conduct that could damage, disable, or impair the App.

4. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, and software, are the intellectual property of Shiny Gemmy Digger or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

5. In-App Purchases and Subscriptions

We may offer paid features through in-app purchases or subscriptions via the App Store. All purchases are subject to Apple’s payment policies. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscriptions through your Apple ID account settings.

6. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of this Agreement or for any reason, with or without notice. Upon termination, all rights granted to you will immediately cease.

7. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your data.

8. Updates and Modifications

We reserve the right to modify or update this Agreement at any time. Changes will be effective when posted in the App or on our website. Your continued use of the App after changes indicates your acceptance of the revised terms.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, revenue, or profits, arising out of or in connection with your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Shiny Gemmy Digger, its affiliates, and their officers, directors, employees, and agents, from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or your violation of this Agreement.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law principles.

13. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration service. If arbitration is not enforceable, disputes shall be resolved in the courts of the relevant jurisdiction.

14. Third-Party Services

The App may include links or access to third-party services. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

15. Children’s Privacy

Our App is not directed to children under 13 (or the applicable age of consent in your jurisdiction). We do not knowingly collect personal information from children without parental consent.

16. Feedback

If you provide us with feedback or suggestions regarding the App, you grant us an unlimited, irrevocable license to use such feedback for any purpose without compensation to you.

17. App Store Terms

This Agreement is between you and Shiny Gemmy Digger, not with Apple. Apple is not responsible for the App or its content. If there is any conflict between this Agreement and the App Store Terms of Service, the App Store Terms will prevail.

19. Entire Agreement

This Agreement, along with our Privacy Policy, constitutes the entire agreement between you and us concerning your use of the App and supersedes any prior agreements.

21. Waiver

Our failure to enforce any provision of this Agreement shall not constitute a waiver of such provision or any other provision.

This Agreement is provided in English. If we provide translations, the English version will govern in the event of a conflict.

23. Changes to the App

We may modify or discontinue the App, or any features or functionality, at any time without notice and without liability.

24. Export Restrictions

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained.

25. Force Majeure

We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, pandemics, labor shortages, or Internet service outages.

26. Assignment

You may not assign or transfer your rights under this Agreement without our prior written consent. We may assign our rights and obligations without restriction.
